Common reasons spousal support payments can be changed

Spousal support, also referred to as alimony, is a set of payments made by a former spouse to their former spouse once a divorce has been finalized. These payments do not last a lifetime. They are only made to help the recipient pay for bills or go back to school while they get their life back in order. They are considered rehabilitative payments. The amount of these payments can be changed due to any of the reasons mentioned below.

If the person responsible for making the alimony payments has gone through any of the following changes in their life, the amount can be changed at the request of the court:

  • A new child has been born to the payer
  • The payer lost their job or was demoted
  • The payer suffered an injury or disability that prevents them from working

If the person receiving the alimony payments has experienced any of the following, they can petition the court for a change in amount or the amount could be automatically changed:

  • The recipient gets remarried
  • The recipient moves in with someone else
  • The recipient obtains gainful employment

It's important to always find out before requesting a change in alimony if the reason you quote will be accepted by the court. It's better to know the answer ahead of time before you spend time in front of a judge.
